On July 24, 2026, Attorney Deng Mingyue, Founding Partner of Starry Law Firm, was invited as a guest speaker for the fifth session of the "Elite Navigation" Foreign-Related Lawyer Talent Training Program organized by the Suzhou Lawyers Association, delivering a lecture on "Indonesian Dispute Resolution Mechanisms and Investment Criminal Risk Prevention."

The training program, hosted by the Suzhou
Lawyers Association and held at the Kenneth Wang School of Law, Soochow
University, brought together 29 young foreign-related lawyers from Suzhou,
along with lawyers and corporate legal counsel from Shanghai, Nanjing, and
Lianyungang.
Taking Indonesian dispute resolution mechanisms
as her starting point, Attorney Deng drew on her cross-border practical
experience as a lawyer admitted in China, the U.S. state of New York, and the
state of Ohio, systematically outlining the key rules and practical challenges
across Indonesia's three primary dispute resolution mechanisms: litigation,
arbitration, and mediation.
During the lecture, focusing on high-frequency
dispute scenarios encountered by Chinese-invested enterprises, Attorney Deng
broke down the structure of Indonesia's court system, civil litigation
jurisdiction rules, and procedural requirements. She also addressed Indonesia's
1999 Law No. 30 on Arbitration and the latest 2025 revisions to the BANI
Arbitration Rules, analyzing the validity of arbitration agreements,
enforcement pathways for arbitral awards, and international arbitration
practice under the framework of the New York Convention.
In the typical case analysis session, Attorney
Deng examined in depth the Four Sea case on contract invalidity arising from
contract language defects, the Astro case on refusal to enforce an arbitral
award, the Sany Group antitrust case, and the case involving the recovery of
penalties imposed on a Chinese-invested nickel mining enterprise. She
identified key risk points including contract language compliance, arbitration
clause design, and dynamic policy monitoring. Attorney Deng emphasized that
commercial contracts involving Indonesia should prioritize arbitration clauses
and be simultaneously executed in an Indonesian-language version, to avoid
validity disputes arising from procedural defects.
In the criminal risk module, Attorney Deng
interpreted Indonesia's new Criminal Code, which took effect in 2026: for the
first time, enterprises are included as subjects of criminal liability, under a
dual-penalty system, with compliance programs serving as an important factor in
assessing fault. Drawing on high-risk areas including corruption and bribery,
tax crimes, and environmental crimes, she provided practical guidance on risks
including criminal fines, business restrictions, license revocation, and executive-level
liability.
Building on its ongoing contributions to
foreign-related legal training, Starry Law Firm will continue to deepen its
presence in the ASEAN legal market, providing end-to-end, multi-jurisdiction
professional legal support for Chinese enterprises expanding overseas, and
helping Chinese-invested enterprises navigate Southeast Asia with stability and
confidence.
